Terms & Conditions

The conditions of bidding, buying, selling, payment and collection at Singha Auctions. Please read them carefully — placing a bid or listing a lot means you accept them.

  1. 01Introduction & acceptance

    These Terms & Conditions ("Terms") govern your access to and use of the Singha Auctions platform, including our website, bidding engine, buyer and seller dashboards, and related services (together, the "Platform"), operated by Singha Auctions (Pvt) Ltd ("Singha Auctions", "we", "us").

    By registering an account, placing a bid, listing a lot, or otherwise using the Platform, you confirm that you have read, understood and agree to be bound by these Terms and by any auction-specific or category-specific conditions published alongside a lot. If you do not agree, you must not use the Platform.

  2. 02Definitions

    • "Lot" means any item, parcel or property listed for auction.
    • "Auction" means a timed sale event containing one or more lots.
    • "Hammer price" means the winning bid amount at the close of a lot.
    • "Buyer’s premium" means the percentage added to the hammer price payable by the buyer, shown on each lot.
    • "Reserve" means the confidential minimum price a seller will accept.
    • "Seller" or "Vendor" means the party offering a lot for sale, whether an individual, business, bank or institution.
    • "Bidder" means any verified account that places a bid.
  3. 03Eligibility & account registration

    You must be at least 18 years old and legally able to enter into binding contracts to register. You agree to provide accurate, current and complete information and to keep it up to date.

    You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use. One person or entity may not operate multiple accounts to circumvent limits or controls.

  4. 04Buyer verification & bidding eligibility

    Certain auctions, categories or high-value lots require identity verification (KYC), a refundable deposit, and/or an approved bidding limit before you may bid. We may request identity documents, proof of address, or company details, and may approve, decline, suspend or revoke bidding eligibility at our discretion.

    You may not place a bid on any lot for which the applicable verification, deposit or credit requirement has not been met.

  5. 05How auctions work

    All auction times, bids, increments and outcomes are determined and recorded server-side. Your browser is never trusted to decide price, timing or the winner. Bids are validated and time-stamped by our engine before they are accepted.

    • Automatic increments: the minimum next bid follows a published increment table that scales with price.
    • Maximum (proxy) bidding: you may set a confidential maximum. The system bids on your behalf, only as much as needed, up to your maximum. Where equal maximums are submitted, the earlier valid bid takes priority.
    • Soft-close (anti-snipe): a bid placed in the closing window extends the lot’s close time. Extension rules vary by auction and category and are applied by the server.
    • One-tap bidding: approved accounts may enable binding one-tap bids after accepting the applicable terms. High-value bids may require additional confirmation.
  6. 06Bids are binding

    Every bid you place is a legally binding offer to purchase the lot at that price plus the buyer’s premium and any applicable taxes and charges. Bids cannot be retracted once placed. If you are the highest bidder when a lot closes and any reserve is met, you are obliged to complete the purchase.

  7. 07Reserve prices

    A lot may be offered with or without a reserve. If bidding does not reach the reserve, the lot passes in (does not sell), although the highest bidder may be offered a time-limited opportunity to meet the reserve. Reserves are confidential and visible only to authorised staff and the seller where permitted. A lot is not confirmed as sold where the result remains subject to owner, bank or institutional approval.

  8. 08Buyer's premium, taxes & fees

    The buyer’s premium applicable to each lot is displayed on the lot page and is added to the hammer price. Taxes, levies, administrative or delivery charges may also apply and, where relevant, are shown before you confirm a high-value bid. All amounts are in Sri Lankan Rupees (LKR) unless stated otherwise.

  9. 09Winning, invoicing & payment

    When you win a lot, an invoice is raised for the hammer price plus buyer’s premium and any applicable charges. During the current phase, payment is made by bank transfer, and you must submit your payment reference (and proof where requested) through your dashboard for verification. Payment is due by the deadline shown on your invoice.

    Title and the right to collect a lot pass only after full payment has been received, verified and released by our team.

  10. 10Default & non-payment

    If you fail to pay by the due date, we may cancel the sale, forfeit any deposit, re-offer the lot, suspend or close your account, recover costs and losses (including any shortfall on a re-sale), and decline your future participation. Persistent or serious default may be referred for recovery or reported as permitted by law.

  11. 11Collection, delivery & release

    Won lots must be collected from the stated location, or delivery arranged where offered, within the collection deadline. You (or an authorised representative with valid identification and the invoice) must present for collection. Storage charges may apply after the free storage period.

    No asset is released until the required payment and approval conditions are satisfied. Every release is recorded in our audit trail and may require staff confirmation and, where used, a QR release code.

  12. 12Condition of lots & inspection

    Lots are generally sold on an "as-is, where-is" basis with all faults. Descriptions, images, estimates, reports and certificates are provided in good faith as a guide only and do not constitute a warranty. You are strongly encouraged to inspect a lot, or arrange independent inspection, and to review any documents before bidding. To the extent permitted by law, you buy relying on your own judgement.

  13. 13Sellers & vendors

    Sellers must be authorised, must have good title and the right to sell, and must provide accurate information and permitted documents. Lots are submitted for approval and may not be published or have their auction rules altered without authorised staff approval.

    Seller commission, applicable charges and settlement terms apply as agreed. Net settlement is calculated after commission and charges and is paid according to our settlement process, which is separate from buyer payment confirmation. Sellers’ confidential contact details and internal references are not shown to buyers.

  14. 14Prohibited conduct

    You must not, and must not attempt to:

    • Place shill or fictitious bids, or bid on your own lot, or otherwise manipulate prices or activity.
    • Use another person’s account, create accounts to evade limits, or bid without the intention or ability to pay.
    • Interfere with, probe or disrupt the Platform, bidding engine or other users, or attempt to bypass security or verification.
    • Provide false information, upload unlawful content, or infringe any third party’s rights.
    • Use the Platform for money laundering, fraud, or any unlawful purpose.

    We maintain audit logs and anti-manipulation controls and may investigate, void bids or sales, and take action against suspected abuse.

  15. 15Deposits, credit limits & refunds

    Where a deposit or credit limit applies, it must be satisfied before bidding. Deposits are applied to your purchase or refunded in accordance with the applicable auction terms once obligations are met. Refunds, where due, are processed to the original payment method or as otherwise agreed, and financial records are retained and auditable.

  16. 16Intellectual property

    The Platform, its software, design, trademarks, and content are owned by or licensed to Singha Auctions and are protected by law. You are granted a limited, revocable, non-transferable licence to use the Platform for its intended purpose. You may not copy, scrape, resell or create derivative works without our written permission.

  17. 17Privacy & data

    We collect and process personal data to operate the Platform, verify users, process transactions, prevent fraud and comply with law. Sensitive information such as identity documents, payment details and confidential maximum bids is protected and access-controlled. Our handling of personal data is described in our Privacy Policy.

  18. 18Disclaimers & limitation of liability

    The Platform is provided on an "as available" basis. While our auction engine and database are the authoritative source of truth, we do not warrant uninterrupted or error-free operation, and a failure of email, SMS, WhatsApp or other notification does not change the official auction result.

    To the maximum extent permitted by law, Singha Auctions is not liable for indirect, incidental or consequential loss, loss of profit, or loss arising from your reliance on lot descriptions, from a lot’s condition, or from third-party services. Nothing in these Terms excludes liability that cannot lawfully be excluded.

  19. 19Indemnity

    You agree to indemnify and hold harmless Singha Auctions, its staff and partners against claims, losses and costs arising from your breach of these Terms, your bids or purchases, your listings, or your misuse of the Platform.

  20. 20Suspension & termination

    We may suspend or terminate your account, cancel bids or sales, or restrict access at our discretion, including for breach of these Terms, non-payment, suspected fraud, or to comply with law. You may close your account subject to settling any outstanding obligations.

  21. 21Dispute resolution & governing law

    These Terms are governed by the laws of Sri Lanka. Any dispute shall first be raised with us in good faith for resolution. Failing resolution, the courts of Sri Lanka shall have jurisdiction, without prejudice to any mandatory consumer rights you may have.

  22. 22Changes to these Terms

    We may update these Terms from time to time. The current version is always available on this page with its "last updated" date. Material changes may be notified to you. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
